Powertrain Terms and Privacy Policy

WARRANTY AND TERMS

Definitions

In these Terms and Conditions:

"Powertrain" means Kmate Pty Ltd acting as The Trustee for Kmate Unit Trust (ABN 36 512 820 728), trading as Kmate or Powertrain.

"Purchaser", "Buyer", or "Customer" means the individual, business or entity purchasing goods from Powertrain.


Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

The benefits provided under this warranty are in addition to your rights and remedies under the Australian Consumer Law.


Initiating a Warranty Claim

Warranty claims are administered by Powertrain.

To assist with assessing your claim, we may request photographs, videos or other reasonable evidence of the reported defect. We may also provide instructions to assist in identifying or resolving the issue.

Where a return is required and a Return Authority (RA) has been issued, the goods must be returned within 14 days, or within another reasonable period agreed between Powertrain and the Purchaser.

Where a refund is approved for purchases made in currencies other than Australian Dollars (AUD), refunds will generally be processed in the original payment currency where possible. Currency exchange rate fluctuations outside our control may affect the final refunded amount. The original AUD selling price remains the reference value of the goods.


Payment of Goods

Legal ownership of the goods remains with Powertrain until full payment has been received for the goods supplied under this or any other agreement between Powertrain and the Purchaser.

Risk in the goods passes to the Purchaser upon delivery.

The Purchaser is responsible for inspecting the goods promptly upon delivery and notifying Powertrain of any damage, shortages or defects within a reasonable period.

While Powertrain will make every reasonable effort to dispatch and deliver goods within the estimated timeframes, delivery dates are estimates only. To the extent permitted by law, Powertrain is not liable for delays caused by events beyond its reasonable control, including delays relating to delivery, warranty assessment, repairs or refunds. Nothing in this clause excludes or limits any rights available under the Australian Consumer Law.


Delivery

Bulky Goods

Shipping charges for bulky or heavy products vary depending on the delivery postcode.

Door-to-door delivery cannot be guaranteed for every location. Customers in regional or remote areas may be required to collect their goods from the nearest freight depot. Please contact us before ordering if you are unsure whether this applies to your location.

If delivery cannot be completed because no one is available to accept the goods, the freight carrier may leave collection instructions or arrange collection from the nearest depot. Additional delivery charges may apply for re-delivery requests.

Estimated delivery times are generally 1–5 business days for metropolitan areas. Longer delivery times may apply to regional and remote locations.

Where delivery to your location is unavailable, you may arrange your own courier or collect your order from our Melbourne warehouse.

Unless otherwise agreed, delivery is to the building entrance only. Assistance from the recipient may be required to unload bulky items.


Next Day Dispatch

"Next Day Local Dispatch" means eligible orders will generally be dispatched within one business day of payment confirmation. This offer applies only to products physically stocked in our own warehouse. Products supplied, warehoused or fulfilled by third-party suppliers are excluded.

Next Day Local Dispatch refers to dispatch only and does not guarantee next-day delivery.

While we make every reasonable effort to dispatch eligible orders within the stated timeframe, delays may occur due to circumstances beyond our reasonable control, including courier delays, supplier issues, system outages or high order volumes. Such delays do not automatically entitle a customer to a refund or discount, unless required under the Australian Consumer Law.


Click & Collect Terms

Full payment must be received before goods can be collected.

Where payment is made by EFT or direct deposit, cleared funds must be received before collection can occur.

Click & Collect is available only for eligible products purchased through:

Collection is available during our published business hours from:

41–45 Mills Road, Braeside VIC 3195

Customers must follow the collection instructions provided via SMS or email.

Please ensure you:

  • bring suitable identification;

  • at the time of collecting the order, present the credit card to our staff which was used to process the payment for orders where payment was processed with a credit card; 

  • bring a vehicle capable of safely transporting your purchase; and

  • arrange assistance if required, as our staff are unable to assist with loading goods into customer vehicles.

Our staff will place the goods adjacent to your vehicle and confirm your order details before releasing the goods.

Customers should inspect all items carefully before leaving the collection point. Once goods have been collected, responsibility for the goods passes to the customer in accordance with these Terms and Conditions.

Where operational health and safety procedures apply, customers must comply with all reasonable directions provided by our staff.

Powertrain reserves the right to modify, suspend or withdraw the Click & Collect service at any time where reasonably necessary.


Pricing and Product Availability

All prices, product availability and promotional offers are subject to change without notice.

We reserve the right to amend pricing, discontinue products, update specifications or withdraw products where necessary due to circumstances including, but not limited to:

  • supplier price changes;

  • product discontinuation;

  • stock shortages;

  • market conditions;

  • technical errors; or

  • publishing errors.

All orders remain subject to product availability.

While we take reasonable care to ensure information published in our catalogues, promotional material and websites is accurate, occasional typographical or technical errors may occur.

Except where required under the Australian Consumer Law, all information is provided on an "as is" basis without additional warranties regarding completeness or accuracy.


Products on Presale

Products advertised as "On Presale" are offered for purchase before they become available for dispatch.

By placing a presale order, you acknowledge that:

  • you are entering into a binding contract for the purchase of the goods;

  • the advertised dispatch date is an estimate only; and

  • dispatch dates may change due to manufacturing, shipping or other operational factors outside our reasonable control.

If the anticipated dispatch date changes materially, we will endeavour to notify affected customers as soon as reasonably practicable.

Where products become available earlier than anticipated, we may dispatch them without prior notice.

Nothing in this section limits or excludes any rights or remedies available to consumers under the Australian Consumer Law, including rights relating to significant delays or non-supply where applicable.


30-Day Money Back Return Policy

At Powertrain, we stand behind the quality of our products. For selected products, we offer a 30-Day Money Back Return Policy for eligible change-of-mind purchases.

Only products specifically advertised on Powertrain.com.au as eligible for a 30-Day Change of Mind Return qualify under this policy. This policy applies only to purchases made directly through Powertrain.com.au and does not apply to purchases made through third-party retailers or marketplaces.

All returns remain subject to these Terms and Conditions.

If your product is eligible, you may contact us within 30 days of the invoice date to arrange a return and receive either:

  • a refund of the purchase price; or

  • a store credit,

excluding the original delivery charge. Where an item was supplied with "Free Delivery", the actual delivery cost incurred by Powertrain may be deducted from the refund or store credit.

Products that are not specifically advertised as eligible under this policy are not eligible for change-of-mind returns.

Conditions of Return

To qualify under this policy, the product must:

  • be returned in its original, unopened and undamaged packaging;

  • include all accessories, manuals and included components;

  • be in new, unused and resaleable condition; and

  • not have been assembled, installed, used or damaged while in the customer's possession.

To request a return, you must contact Powertrain by phone or email within 30 days of the invoice date and follow the return instructions provided by our team.

Once approved, the product must be returned within 14 days.

Unless otherwise required under the Australian Consumer Law, customers are responsible for the cost of returning change-of-mind items and remain responsible for the goods until they are received by Powertrain.

After receiving the returned product, we will inspect it and, if approved, process your refund or store credit as soon as reasonably practicable. An email confirmation will be provided once processing has been completed.

If the returned product does not meet the requirements of this policy, Powertrain may decline the return. In this case, the customer will be responsible for the cost of return shipping or collection within seven (7) days of notification.

Powertrain may amend or withdraw this Change of Mind Policy from time to time, provided that any changes will not affect returns already approved under this policy.

Nothing in this policy limits, excludes or replaces any rights or remedies available under the Australian Consumer Law.


Warranty

Minor and Major Faults

Subject to the Australian Consumer Law, Powertrain warrants that products supplied will be free from defects in materials and workmanship for a reasonable period, taking into account the nature, price and intended purpose of the product.

Unless a longer period is reasonably expected under the Australian Consumer Law or is expressly stated in the product listing, warranty coverage generally applies for:

  • Domestic use – up to 12 months from the date of purchase; and

  • Commercial use – up to 90 calendar days from the date of purchase.

This manufacturer's warranty is separate from, and in addition to, your rights under the Australian Consumer Law.

This warranty does not cover normal wear and tear, consumable components or minor accessories, including but not limited to:

  • storage bags and cases;

  • belts and ropes;

  • carry straps;

  • free gift or bonus items supplied with the main product; and

  • other consumable accessories supplied with the product.

Where requested, products or photographs of the alleged fault must be provided to enable assessment of the warranty claim.

Warranty claims may be declined where damage has resulted from:

  • misuse or abuse;

  • accidental damage;

  • improper storage;

  • incorrect installation or assembly;

  • failure to perform recommended maintenance;

  • use contrary to operating instructions;

  • unauthorised repairs or modifications;

  • opening packaging with knives or blades causing damage;

  • neglect; or

  • any cause unrelated to a manufacturing defect.

Additional product-specific warranty exclusions are outlined later in these Terms and Conditions.


Warranty Exclusions

Examples of issues not covered by warranty include, but are not limited to:

  • misuse or operation contrary to the instruction manual;

  • use for purposes other than those advertised;

  • inadequate cleaning, lubrication or maintenance;

  • improper storage;

  • weather damage where the product is not designed for permanent outdoor exposure;

  • incorrect fuel or oil mixtures;

  • inability to operate equipment due to incorrect starting procedures or tuning;

  • storm or wind damage resulting from improper installation or inadequate securing;

  • incorrect assembly;

  • accidental damage during installation or adjustment;

  • unauthorised modifications or repairs;

  • scratches, cuts or cosmetic damage caused during unpacking;

  • products sold as ex-demonstration or used products (unless otherwise stated); and

  • personal comfort preferences relating but not limited to foam padding, backrest and seat.


Items Not Covered by Warranty

The following accessories are generally regarded as consumable items and are not covered by warranty unless required by the Australian Consumer Law:

  • carry bags;

  • storage bags;

  • carry straps;

  • complimentary gifts;

  • Consumable parts; 

  • Batteries;

  • promotional bonus items.

  • Silicone oil. 


Warranty Conditions

To make a valid warranty claim:

  • the defect must be reported within a reasonable time after it is discovered;

  • the product must not continue to be used once the defect becomes apparent where further use could worsen the damage;

  • claims must be made during the applicable warranty period;

  • the warranty applies only to the original purchaser and is not transferable;

  • Powertrain may require photographs, videos or return of the affected product or components for assessment.

Where a warranty claim is accepted, Powertrain will cover the reasonable cost of returning repaired or replacement products to the customer.

Nothing in this warranty limits or excludes your rights under the Australian Consumer Law.

Where permitted by law and agreed with the Purchaser, Powertrain may offer a repair, replacement, partial refund or full refund as an appropriate remedy.

Unless otherwise stated, this warranty does not apply to ex-demonstration or used products.


Damaged on Arrival (DOA) Warranty Claims

This provision supplements the standard warranty for product failures and applies to goods that:

  • arrive damaged during transit;

  • have missing parts;

  • are delivered incomplete; or

  • contain manufacturing defects identified upon delivery.

Claims under this provision must be made within a reasonable period after delivery (generally within 7 calendar days).

To lodge a DOA claim, the Purchaser must notify Powertrain by email or in writing as soon as reasonably practicable after discovering the issue.

This warranty does not cover cosmetic damage, including cuts or scratches caused by opening the packaging with knives, blades or other sharp objects.

Unless otherwise stated in the product listing, this provision does not apply to ex-demonstration or used products.


Returning Goods for Warranty Assessment

Where required to assess or remedy a warranty claim, Powertrain may request that the goods or relevant parts be returned for inspection.

No refund, replacement or repair will be approved until the returned goods or components have been received and assessed, unless otherwise required under the Australian Consumer Law.

Where a return is authorised:

  • the goods must be returned using the freight method approved by Powertrain;

  • products should, where reasonably possible, be disassembled and repacked in a manner suitable for safe transport;

  • a valid Return Authority (RA) number must accompany all authorised returns; and

  • returned goods should be dispatched as soon as reasonably practicable after the RA has been issued.

Where reasonably practical, customers are responsible for arranging the initial return shipment using the freight method approved by Powertrain.

If, following assessment, Powertrain confirms that the product is faulty and covered by warranty, reasonable return freight costs will be reimbursed.

If inspection determines that:

  • no fault exists;

  • the reported fault cannot be reproduced;

  • the damage resulted from misuse, neglect or accidental damage; or

  • the fault is outside the scope of the warranty,

the Purchaser may be responsible for:

  • reasonable freight costs incurred in returning the goods;

  • reasonable inspection costs of $60.00 per hour, calculated on a pro-rata basis; and

  • any applicable return freight charges.

For products that are too large or heavy to be reasonably returned by the Purchaser, Powertrain may arrange collection where appropriate. If inspection confirms that the product is not faulty or is not covered under warranty, the Purchaser may be required to reimburse the reasonable transport and inspection costs incurred.

Powertrain aims to assess warranty returns as promptly as possible and may require up to 14 calendar days after receiving the returned goods to complete inspection, repair or assessment before determining the appropriate remedy.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.


Force Majeure

Powertrain will not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to:

  • fire;

  • flood;

  • storm;

  • natural disasters;

  • pandemic or public health emergencies;

  • technical failures;

  • equipment breakdown;

  • industrial disputes;

  • transport interruptions;

  • shortages of materials or supplies;

  • government action; or

  • any other event beyond Powertrain's reasonable control.

Where a Force Majeure event occurs, Powertrain may suspend, vary or cancel affected orders or contractual obligations to the extent reasonably necessary.

Nothing in this clause limits any rights available to consumers under the Australian Consumer Law.


Australian Consumer Rights

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantees, rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

Where any provision of these Terms is inconsistent with the Australian Consumer Law, the Australian Consumer Law will prevail to the extent of the inconsistency.

Product-Specific Warranty Exclusions

Unless otherwise required under the Australian Consumer Law, the following product-specific exclusions apply.

Trampolines and Trampoline Accessories

The warranty does not cover:

  • tears or rips in safety nets caused by misuse, accidental damage or normal wear;

  • normal wear and tear of pole protectors;

  • rust developing on the trampoline and its accessories; 

  • fading of the surfaces; 

  • deterioration from UV exposure; 

  • normal wear and tear.

Powertrain is not responsible for injury, property damage or consequential loss arising from products that have not been installed or secured in accordance with the manufacturer's instructions. 


Product-Specific Warranty Exclusions

Unless otherwise required under the Australian Consumer Law, the following product-specific exclusions apply.

Powertrain is not responsible for:

  • Providing software updates for any of the products;

  • Injury, property damage or consequential loss arising from products that have not been installed or secured in accordance with the manufacturer's instructions. 



Factory Refurbished Products

Where a product is advertised as Factory Refurbished, it has been professionally restored to working order by an authorised third-party refurbishment provider.

Factory Refurbished products have been inspected, tested, cleaned and, where necessary, repaired to meet the applicable product standards.

Unless otherwise stated in the product listing:

  • the product may not be supplied in its original packaging;

  • the product may show minor cosmetic blemishes or signs of previous use that do not affect functionality; and

  • only the accessories, software and documentation specifically listed in the product description are included.

Customers should rely only on the information provided in the relevant product listing when determining what is included with a Factory Refurbished product.


Advertising and Website Errors

Powertrain makes every reasonable effort to ensure that product descriptions, specifications, pricing, availability and shipping information published on our website are accurate.

Despite these efforts, errors or omissions may occasionally occur.

Where a genuine pricing, product description, availability or shipping error has occurred, Powertrain reserves the right to cancel an order prior to dispatch and provide a full refund of any amount paid.

Any such cancellation will be communicated to the customer as soon as reasonably practicable.

Nothing in this clause limits any rights available to consumers under the Australian Consumer Law.

Product photographs are provided for illustrative purposes only.

Actual colours, finishes and product appearance may vary due to manufacturing variations, lighting conditions and individual display settings. Such variations alone do not constitute a product fault.


Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia.

The parties submit to the non-exclusive jurisdiction of the courts and tribunals of Victoria.
